When to File Leave Claims by State

This guide will walk you through when to file your state claims for medical, parental and caregiver leaves. Please refer to this guide when preparing to file your state claims whether in Cocoon or within the state portal.

California (CA)

  • SDI (Disability): File on or after day 9 of disability. Claim must be filed within 49 days of the leave start date.

  • PFL (Bonding/Care): File on or after the first day of leave. Claim must be filed within 41 days of the leave start date.


Colorado (CO – FAMLI)

All leave types (Disability, Bonding, Caregiver):

  • File up to 30 days before leave or within 30 days after leave starts.

  • Benefits are not paid before the first day of absence (can be paid retroactively).

Bonding note:

  • Can apply 30 days in advance, but the claim remains draft until proof of birth is submitted.


Connecticut (CT)

All leave types (Disability, Bonding, Caregiver):

  • File 30 days before leave (if foreseeable).

  • If not foreseeable → file as soon as practicable.


Delaware (DE)

  • Foreseeable leave (all types): File 30 days in advance.

  • Unforeseeable (Disability/Caregiver):

    • File within 24–48 hours if possible

    • No later than 30 days after leave starts


Hawaii (HI)

  • Disability (TDI):

    • File within 90 days of disability

    • After 90 days → risk reduced benefits

    • After 26 weeks → ineligible

  • Bonding/Caregiver (HFLL):

    • Provide notice as soon as practicable

    • Ideally 30 days in advance


Massachusetts (MA)

All leave types:

  • Apply up to 60 days before leave

  • Must give employer 30 days notice

  • If not possible → notify as soon as possible


Minnesota (MN)

All leave types:

  • Cannot file more than 60 days in advance

  • If you can't apply ahead of time, you should submit your Paid Leave application as soon as possible after starting your leave. You may be asked for information about why you could not apply sooner. Apply as soon as you know you need to take leave.


New Jersey (NJ)

  • Disability:

    • File on or after first day of disability

    • Must file within 30 days

  • Bonding:

    • Continuous leave:

      • Start application up to 60 days in advance

      • Submit initial info within 14 days

      • Finalize within 14 days after leave starts

    • Intermittent leave:

      • File after first leave segment ends

  • Caregiver:

    • Same rules as continuous bonding

    • File within 30 days if applying after leave starts


New York (NY)

All leave types:

  • File up to 30 days before leave starts

  • You must submit your completed request package to your employer's insurance carrier within 30 days after the start of your leave to avoid losing benefits.


Oregon (OR)

All leave types:

  • File 30 days before leave OR

  • Up to 30 days after leave starts


Rhode Island (RI)

  • TDI (Disability):

    • File as soon as possible

    • Must file within 90 days

  • TCI (Bonding/Care):

    • Must file within 30 days of leave start

Cannot file before leave begins — early claims may be rejected or canceled


Washington (WA)

  • Disability & Caregiver:

    • File within 30 days after qualifying event

  • Bonding:

    • File after birth


Washington, D.C. (DC Paid Family Leave)

  • All leave types:

    • Must file after the qualifying event

    • Recommended: file within 30 days

    • Filing late may result in lost backpay eligibility
