If your leave request has been denied and you are still looking to take a leave of absence, you can explore the following options:

Request leave an accommodation leave (for medical leave only)

This option is available for medical leave only. If you are seeking a caregiver leave, you cannot request an ADA leave accommodation.

When you design your leave plan, Cocoon automatically checks for any entitlements that may apply to your plan and provide you a protected leave of absence. These entitlements include your employer's leave policies, as well as federal and state leave laws such as the federal Family & Medical Leave Act (FMLA) or the California Family Rights Act.

If your leave request has been denied and/or is not eligible for coverage by your employer's policy or leave laws, you may be able to pursue a leave of absence through the Americans with Disabilities Act (ADA). Cocoon will walk you through each step of request a leave accommodation. We'll notify you of your employer's decision—if they approve your request, you can update your new accommodation leave plan right in your Cocoon Dashboard.

I'm currently on leave - what does it mean if my leave has been denied?

If your leave is denied, this means that your leave of absence is not covered by any entitlements or programs, or official employer leave medical or caregiver leave policies. We recommend reaching out to your HR team as soon as possible to coordinate the next steps.

How are entitlements determined?

The leave entitlements that may be available to you are determined by your tenure with your current employer, as well as your state of residence. Federal programs like the FMLA require a 12-month tenure requirement and a minimum of 1,250 hours worked in the 12 months preceding leave before becoming eligible for protections. State protections may become available to you at different tenure marks.
