How do I file a claim with CO FAMLI?

Colorado FAMLI has created a user-friendly guide, "My FAMLI+," to assist you in filing your claim. Here are some helpful links to get you started exploring their guides and filing your claim.

How to file for (Pre-Birth) Birthing Parent’s Serious Health Condition Prior to Childbirth?

Welcoming a new child is an exciting yet stressful time for parents. Fortunately, Colorado’s Family and Medical Leave Insurance (FAMLI) program offers support for parents looking to bond with their new child through birth, adoption, or foster placement.

  1. Claim Timing: Bonding leave can only begin after the child’s arrival. However, expectant birthing parents can file a medical claim for their own serious health condition prior to childbirth. This option allows them to start receiving wage replacement before the baby arrives, provided they have their healthcare provider’s approval.

  2. Filing for Bonding Leave: After the birth, parents can file a new claim for bonding leave with proof of birth, such as a birth certificate or verification from a healthcare provider. Non-birthing parents should follow this process as well.

  3. Additional Leave for Complications: Colorado law permits birthing parents to take up to four additional weeks of FAMLI leave for complications related to pregnancy or childbirth. A separate claim must be filed for this additional leave.

  4. Eligibility and Notification: Both mothers and fathers are eligible for FAMLI bonding leave, and they do not need to take their leave simultaneously. Employers must receive 30 days’ notice before a parent begins their bonding leave if the child’s arrival is foreseeable.

  5. Understanding FAMLI vs. FMLA: It's important to note that FAMLI is paid leave, unlike the federal Family and Medical Leave Act (FMLA), which offers unpaid, job-protected leave. FAMLI is available to all employees, including self-employed and gig workers.

What if I have a Private Disability Claim Alongside a State Claim?

Please Note: If your employer uses Lincoln Blue as their private insurance carrier, they will contact you directly to initiate your private disability claim. If you haven't heard from them within a week of your leave's start date, reach out to Lincoln Financial Group.

What are my next steps once my Private Disability Claim is submitted?

Our team will usually submit your claim to your private carrier within 24 hours of receipt and you'll receive an email to confirm. Here are some useful tips to help you take proactive steps and ensure speedy approval.

  • Follow up with your private insurance carrier shortly after receiving our confirmation (ideally 2 business days) that your claim was submitted to ensure they have everything they need to offer you a swift approval.

  • We don't collect bank information so your benefit payments will be in the form of checks, if you're interested in setting up direct deposit, this call to them would be an ideal opportunity to learn if that might be possible.
